I will say this about it: none of this is legal by any stretch in the European Economic Area. Or in any jurisdiction that is a signatory to the Budapest Convention on Cybercrime. /cc @briankrebs@infosec.exchange

This explains a lot about what I’ve been experiencing with combatting scrapers. https://blog.includesecurity.com/2026/06/the-smart-tv-in-your-livingroom-is-a-node-in-the-aiscraping-economy/

Same for whatever implementation of the Budapest Convention on Cybercrime you are living under in your jurisdiction. Also for webcrawlers that ignore robots.txt. They are committing a criminal offence.
I really do not get why nobody is running to their public prosecutors to have a go at this.

I am baffled why people are going "oh no what is to be done" about openai breaking into a competitors computers, when it is incredibly obvious: Charge them under the CFAA. "Oh but their research". Sandbox it from the Internet. "Oh it's too hard to do that". Skill issue, get good.
As I said: Weird that Robert Morris got charged for all of the computers his worm broke into. After all, he didn't do it, the computer program did it, that's completely different, apparently. https://en.wikipedia.org/wiki/Morris_worm

So, faith in AI has become a tenet of the Cult of Professionalism now?

I have, after two years, allowed myself to talk about my experiences with AI madness again, this time with the benefit of speaking to people all around the world, including Fortune 500 executives. This one is on my regular blog for casual readers, and cross-posted to the company blog if you need to share this with someone and have it look official.

@jon@gruene.social Running the risk of mansplaining, but in quite a few EU member states their national drivers license is a valid ID, but foreign ones are not, simply because they have not yet been standardised across the EU. Especially the German ones are a nightmare because some German states have issued drivers licenses with indefinite validity.

@pluralistic@mamot.fr No, they are not. Said consent is only required for data that goes beyond data necessary for the website to function (and extensive interpretations of that include first-party analytics). And this is not a GDPR-requirement, but an ePrivacy requirement with a reference to the predecessor of the GDPR for what 'consent' means. It is malicious and performative not-quite-compliance.
